Searchers have to read the following statements before proceeding to search
For Bankruptcy Search Report
Personal data disclosed in the bankruptcy search report may only be used for ascertaining
(1) whether a particular individual is a person against whom a bankruptcy petition has been presented or a bankruptcy order has been made under the Bankruptcy Ordinance; and
(2) the period of the bankruptcy of that individual.
For Individual Voluntary Arrangement (IVA) Search Report
Personal data disclosed in the Individual Voluntary Arrangement (IVA) search report may only be used for ascertaining whether a particular individual is or has been subject to an IVA.
Any person who uses the personal data for any purposes other than stated above or in contravention of the requirements under the Personal Data (Privacy) Ordinance (Cap. 486) (PDPO) is liable to pay compensation and may be subject to enforcement action under the PDPO.
Purpose of Collection
(1) Personal data provided by the searcher to the Official Receiver’s Office ("the ORO") in this application for e-Search Services will be used by the ORO for the purpose of carrying out the Official Receiver’s functions relating to the provision of services by the ORO.
(2) Provision of the searcher’s personal data is voluntary. If the personal data are not provided, the searcher will not be able to access the e-Search Services.
Classes of Transferees
(3) The personal data provided by the searcher may be disclosed or transferred to relevant parties where such disclosure or transfer is necessary for the purpose as stated in paragraph 1 above. Such personal data may also be disclosed or transferred to law enforcement agencies as permitted under the Personal Data (Privacy) Ordinance (Cap. 486).
Notice
(4) The searcher has the right to request access to and correction of his/her personal data held by us pursuant to sections 18 and 22 of the Personal Data (Privacy) Ordinance (Cap. 486). Any such request for access to and correction of such personal data may be made to any officer acting for or on behalf of the Official Receiver at the ORO, 10th Floor, High Block, Queensway Government Offices, 66 Queensway, Hong Kong.
